It’s hard to believe that in fewer than thirty days, the first quarter of 2021 will be over. This month’s newsletter covers recent COVID-related legislation impacting renters, a new team member, and a reminder about our attorney consultations.
Although more people are getting vaccinated and the economy is slowly reopening, many California renters continue to struggle. In response, on January 29, 2021, Governor Newsom signed legislation to extend California’s eviction moratorium through June 30, 2021, protecting renters suffering economic hardships brought on by the COVID-19 pandemic. SB 91 pauses evictions for tenants who declare under penalty of perjury an inability to pay all or part of the rent due to a COVID-related reason. Renters are still responsible for paying unpaid amounts to property owners, but those unpaid amounts cannot be the basis for an eviction, even after the moratorium ends.
SB 91 also establishes the State Rental Assistance Program to allocate the $2.6 billion in federal rental assistance California will receive. The program will target aid to income-qualified tenants most at-risk with unpaid back rent. The program will also extend assistance to property owners who agree to waive twenty percent of unpaid rent. Property owners who agree to the waiver will be eligible for eighty percent in rent reimbursements for amounts owed between April 1, 2020 and March 31, 2021.
Since our last newsletter, we have welcomed another new team member. Sergio “Serge” E. Hurtado joined Tenant Law Group on February 10 as a Case Manager. He is the first point of contact for litigation clients with questions about their case, provides regular status updates to litigation clients, and works closely with the litigation team to ensure that client matters being prosecuted and resolved as quickly as possible. Before joining Tenant Law Group, Serge worked as an assistant at another landlord-tenant law firm in the San Francisco Bay Area. Fully bilingual, Serge speaks fluent English and Spanish.
